Terms of Service
Plain version: By using Falah you accept these terms. Subscriptions auto-renew via Apple or Google. You can cancel anytime in your phone's settings. We're a small Australian company (Mykoala Pty Ltd) and we'll resolve any issues in good faith.
1. Acceptance of Terms
By downloading, installing, or using the Falah application ("the App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree to these Terms, do not use the App.
The App is operated by Mykoala Pty Ltd (Australia), trading as Mykoala ("we", "us", "our"). Our legal contact is legal@mykoala.com.au.
These Terms apply to both the iOS and Android versions of the App and to any future updates or new versions.
2. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this document and may provide notice within the App. Your continued use of the App after any changes constitutes acceptance of the updated Terms.
3. Licence to Use the App
3.1 Licence Grant
Subject to your compliance with these Terms, Mykoala Pty Ltd grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on a device you own or control, for your personal, non-commercial purposes.
3.2 Restrictions
You must not:
- Copy, modify, distribute, sell, or lease any part of the App or its content
- Reverse engineer, decompile, or attempt to extract the source code, except as permitted by applicable law
- Use the App to provide services to third parties on a commercial basis without our written consent
- Remove or alter any proprietary notices or labels in the App
- Use the App in any way that violates applicable laws or regulations
3.3 Updates
We may release updates to the App from time to time. Some updates may be required for the App to continue functioning correctly. We recommend keeping the App updated to the latest version.
4. Intellectual Property
The App, including all content, features, design elements, and code, is owned by Mykoala Pty Ltd or its licensors and is protected by Australian and international intellectual property laws.
Quran text used in the App is sourced from open, public-domain translations. Audio content (adhan recordings) is used under licence. Prayer time calculations use the adhan open-source library. These third-party components are subject to their own respective licences.
Your use of the App does not grant you any ownership rights in the App or its content.
5. Subscriptions and Payments
5.1 Available Plans

All prices are in Australian dollars and include applicable taxes. Prices may vary by region based on local App Store / Play Store pricing tiers.
5.2 Auto-Renewal
Monthly and annual plans are auto-renewable subscriptions. Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the end of the current period. The lifetime plan is a one-time purchase — no recurring billing.
Payment will be charged to your Apple ID or Google Play account at confirmation of purchase and at the start of each renewal period.
5.3 Free Trial
If we offer a free trial period for any plan, you will not be charged until the trial ends. If you do not cancel before the trial ends, you will be charged for the subscription at the rate disclosed at the time of sign-up. Cancelling during the trial will not result in a charge.
5.4 How to Cancel
iOS (App Store): Settings → [Your Name] → Subscriptions → Falah → Cancel Subscription. Apple's cancellation guide.
Android (Google Play): Open Google Play → tap your profile icon → Payments & subscriptions → Subscriptions → Falah → Cancel Subscription. Google's cancellation guide.
Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date.
5.5 Price Changes
We may change subscription prices at any time. We will give reasonable advance notice of any price change. If you do not agree to a price change, you should cancel your subscription before the change takes effect.
5.6 Restoring Purchases
If you reinstall the App or switch devices, you can restore your purchase using the "Restore Purchases" function within the App. This requires you to be signed in to the same Apple ID or Google account you used for the original purchase.
6. Refunds
All purchases of Falah subscriptions and the lifetime plan are processed by Apple (App Store) or Google (Google Play). We do not process refunds directly. Refund eligibility is governed entirely by the refund policy of the relevant platform:

If you have a billing dispute, please contact Apple or Google directly via those links. We are unable to issue credits, refunds, or partial refunds on their behalf.
7. Charitable Allocation (Zakat)
7.1 Our Commitment
A portion of subscription revenue generated by Falah is allocated as zakat — the obligatory act of charity that is one of the Five Pillars of Islam — to Muslim communities in Fiji. This distribution is made through the developer's personal family network and local mosque connections in Fiji, which are known to the developer and verified through ongoing community relationships.
7.2 What This Is Not
This charitable allocation is not a registered charitable donation:
- Mykoala Pty Ltd is not a registered charity or deductible gift recipient (DGR) under Australian law.
- You do not receive a tax deduction for any portion of your subscription payment.
- This is a personal and voluntary commitment by the developer — a reflection of religious obligation and community connection — not a legally binding contractual obligation to any third party.
- No portion of your subscription is processed or receipted as a tax-deductible gift.
7.3 Transparency
We publish a Transparency page that explains in plain language how subscription revenue is allocated, including the approximate share directed to zakat. This page is updated periodically with honest, non-audited notes on allocations.
8. User Responsibilities
You are responsible for:
- Ensuring your device meets the minimum requirements to run the App
- Keeping your device and App Store / Play Store account credentials secure
- Using the App in compliance with all applicable laws in your jurisdiction
- Any costs associated with accessing the internet on your device
The App provides prayer time calculations based on well-established astronomical and jurisprudential methods. You are responsible for verifying prayer times locally, particularly in edge cases (polar regions, unusual geographic circumstances, or during Ramadan). See Section 10 for our disclaimer on prayer time accuracy.
9. Privacy
Your use of the App is also governed by our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
In summary: Falah stores all personal data (location, preferences, streak) on your device only. We do not operate servers that receive personal data. No accounts are created.
10. Disclaimer of Warranties
Prayer time accuracy: Prayer times in Falah are calculated using the adhan open-source library, applying widely used jurisprudential calculation methods (such as MWL, ISNA, Egyptian, and others). Calculations are astronomical estimates and may differ from times announced by local mosques, particularly during edge-case conditions. You should verify prayer times with a local authority for obligatory prayers.
General disclaimer: To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
Nothing in this clause limits any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), which cannot be excluded by contract.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
- Our total aggregate liability to you for any claim arising from these Terms or your use of the App is limited to the amount you paid for the App in the 12 months immediately preceding the claim.
Nothing in this clause excludes liability for death, personal injury caused by our negligence, fraud, or any liability that cannot be excluded under Australian Consumer Law or other applicable mandatory law.
12. Third-Party Services
The App integrates with third-party services including RevenueCat (subscription management), Apple App Store, Google Play, and OpenStreetMap. These services are governed by their own terms of service and privacy policies. We are not responsible for the terms, availability, or data practices of any third-party service.
13. Termination
13.1 By You
You may stop using the App at any time by uninstalling it from your device and cancelling any active subscription as described in Section 5.4.
13.2 By Us
We may suspend or terminate your access to the App (including premium features) if:
- You materially breach these Terms
- We are required to do so by law or a court order
- We decide to discontinue the App
If we discontinue the App and you have a paid subscription with remaining time, we will endeavour to provide a pro-rata refund where possible, subject to the refund policies of Apple and Google.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or your use of the App will first be attempted to be resolved by contacting us at legal@mykoala.com.au. We are committed to resolving disputes promptly and in good faith.
If informal resolution fails, disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
If you are a consumer in another jurisdiction, nothing in this clause limits any mandatory rights you have under the consumer protection laws of your home jurisdiction.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force.
16. Entire Agreement
These Terms, together with the Privacy Policy and the Transparency page, constitute the entire agreement between you and Mykoala Pty Ltd with respect to the App and supersede all prior agreements or understandings.
